Federal Court Orders Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge wrote in her ruling.
The case originates in a mistaken deportation to El Salvador in March, which US authorities later admitted was an mistake. Following his return to the United States to answer human smuggling charges, he was held in immigration detention.
In her order, the judge noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

The court proceedings involve disputed assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
